品牌保护：ARRIDC被宣告无效

近日，ARRI在中国针对由济南阿莱达实业有限公司于2018年获准注册的商标 所提出的无效宣告请求一案中获得了重要的胜利。

国家知识产权局在其无效宣告请求裁定中认为，ARRI在本案中所提交的证据足以证明ARRI的注册商标“ARRI”及 在济南阿莱达实业有限公司申请注册 商标前便大量使用并具有一定影响；济南阿莱达实业有限公司申请注册的 商标完整的包含了ARRI集团注册商标的字母“ARRI”且其提供的证据材料不足以证明 已足以与ARRI的注册商标“ARRI”及 相区分。

国家知识产权局认为， 商标与ARRI的注册商标使用在同一种或类似商品上易使相关公众对商品的来源产生混淆误认，已经构成商标法下所指的近似商标，故依法裁定对 商标予以无效宣告。本次裁定对ARRI在中国境内的维权活动有着积极和重要的影响。（商评字【2020】第0000199988号）

ARRI has received a favorable decision in its petition to declare invalidation of the mark, which was registered by Jinan Alaida Co.,Ltd, in 2018.

The CNIPA finds the evidences presented by ARRI unmistakably show ARRI’s registered trademark was in use before Jinan Alaida Co., Ltd registered theirs and has achieved definite fame; “ARRIDC” contains the entirety of the “ARRI” trademark and Jinan Alaida Co., Ltd has failed to prove that it has used the mark to an extent for the relevant public to be able to distinguish its mark from ARRI’s registered trademarks.

The CNIPA finds the coexistence of   and ARRI’s registered trademarks on identical or similar goods would cause confusion among the relevant public as to the source of goods and therefore constitutes to ‘similar marks’ under Trademark Law, hence decides should be invalided. This decision is very important and positive for ARRI’s brand protection activities in China. ([2020]No.0000199988)

The aforementioned mark holder claims in their counterarguments, that its purpose is to support and bring prosperity to the Chinese film industry. We feel privileged to work alongside the limitless talented Chinese filmmakers to create top level Chinese media and we affirm to continue our mission for the long term.
